The petitioner submitted an application before the concerned authority on 6th February, 2023 for grant of long term settlement of an area of 18 decimals of land adjoining the petitioner's plot for the purpose of egress and ingress. The application was forwarded by the Additional Secretary to the Government of West Bengal to the Additional District Magistrate and District Land and Land Reforms Officer, Purba Medinipur by a letter issued on 17th February, 2023 requesting enquiry into the matter and submission of a detailed proposal for grant of long term settlement in favour of the petitioner. The matter is still pending.

Learned counsel for the petitioner seeks a direction upon the authority to consider the application at the earliest.

Learned counsel for the State respondents submits that the 4th respondent be directed to consider the application in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider the application submitted by the petitioner dated 5th April, within two months from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
