Sushil Kumar Bhansali ... petitioner The present revisional application has been preferred by Sushil Kumar Bhansali under Section 482/397 of Cr.P.C. on 24.10.2017 for quashing of the order dated 19.03.2015 and 19.07.2014 passed in Complaint Case No. 418573 of 2014 by Learned 18th Metropolitan Magistrate Court at Calcutta. It is noted that none appears today to represent the petitioner or the opposite party. The petitioner was last represented on 27.11.2024. Thereafter, none appeared to represent him despite the opportunity given him on last three consecutive.
In the last order dated 25.04.2025, one more opportunity was given to the petitioner to appear on the adjourned date, but none appeared to represent the petition even today. This is a very old matter pending for more than 8 years, this Court has taken it up today for passing an order on the basis of the material available on record.
I have perused the impugned order dated 19.03.2015 whereby the Learned Magistrate directed to issue process upon the accused persons after going through with the
material available on record. I do not find any illegality, irregularity and impropriety in this order as it was passed on the basis of considering sufficient grounds available on record to proceed against the accused persons for the offence under Sections 138/141 of the N.I. Act.
I have also perused the impugned order dated 15.7.2017 by which the petition filed by accused nos. 1, 4 and 8 for praying time to file written objection against the petition of complaint, was rejected, after considering the material on record.
Prima facie, I do not find any merit in the application. I also do not find any perversity in the impugned orders dated 19.03.2015 and 15.07.2017 which do not require interference at this stage.
Accordingly, the revisional application is dismissed on merits available on record. The connection application is also disposed of.
Interim order stands vacated.
