Kausik (Rejected) CRM (M) 2206 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sarenga Police Station Case No. 20 of 2021 dated 29.04.2021 under sections 302/201/34 of the Indian Penal Code, 1860;

Learned advocate for the petitioner submits that the petitioner is in custody for 4 years 6 months and 27 days and out of 14 witnesses proposed to be examined only 12 witnesses are examined and the examination of the rest 2 witnesses are continuing for a considerable period of time and there is no effort on behalf of the prosecution to conclude the evidence. Learned advocate for the State submits a report which reflects that the Medical Officer, namely Dr. Mainak Tarafdar has informed that he would be engaged with external examination of some medical colleges from 11.12.2025 till 19.12.2025. The learned Trial Court is directed to fix date in the first week of January, 2025 and continue with the

examination of this two witnesses till the evidence of the witnesses are complete.

All efforts be made to conclude this two witnesses by 15.02.2026.

At this stage, I am not inclined to release the petitioner on bail. However, the petitioner shall be at liberty to approach this Court after the aforesaid period is over. Accordingly, CRM (M) 2206 of 2025 is dismissed. Report submitted be kept with the record.

No unnecessary adjournment be granted to any of the parties. The trial of the case would continue in spite of resolution of the local bar.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
