1. Petitioner is in custody for about two year and two months. He submits there is delay in trial he prays for bail.

2. Learned counsel appearing for the State submits trial is in progress. Seven out of ten witness have been examined.

3. We have considered the materials on record. A large consignment of 6000 bottles of Phensedyl syrup was recovered from a vehicle. Petitioner was the driver of the vehicle. Trial has substantially progressed. Seven out of ten witnesses have been examined.

4. Under such circumstances, we are of the opinion, petitioner is not entitled to bail either on merits or on the score of delay in trial. Trial be expedited by fixing schedules at short intervals and be concluded at an early date preferably within a year from the next date fixed for recording of evidence.

5. Under such circumstances, we are not inclined to grant bail to the petitioner.

6. Accordingly, the application for bail, is thus, rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
