On the basis of written complaint lodged by one Saugata Kundu Cyber Crime PS Case no. 56/25 dated 13th September, 2025 was registered. The petitioner submits that he is not aware of the contents of the FIR lodged against him. In reply to a notice issued upon him under Section 35(3) of the BNSS he sent a representation before the police authority seeking details of the FIR which was not responded to. Admittedly the petitioner has not complied with the notice under Section 35(3) of the BNSS.

The report submitted by the State indicates the finding arrived at by the investigating officer in course of investigation which is in progress. Learned counsel for the State submits that the FIR has been uploaded in the website. In view of the above, the petitioner is directed to cooperate in investigation. The investigating officer is directed to conduct a fair and impartial investigation and take the same to its logical conclusion in accordance with law.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
