Learned advocate appearing for the petitioners submits that petitioners surrendered on 17.09.2025 and since then, they are in custody. Additionally, it has been submitted that there has been no recovery from the possession of the petitioners.
Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the order dated 14.08.2025 passed in CRM(A) 2572 of 2025 wherein prayer for anticipatory bail of the present petitioners has been rejected on the grounds that the statement of the co-accused reflects regarding phone calls between the present petitioners and the co-accused at the relevant point of time.
However, the case diary do not reflect that there was any further recovery except the initial recovery of 117 bottles of phensedyl from the other accused persons who are in custody.
It has also been pointed out that there was another case being Sagarpara P.S. Case No. 165 of 2021 dated 28.09.2021 against the petitioner no.1.
Be that as it may, records reflect that five accused persons have been implicated in connection with the instant case. So far as the present petitioners are concerned, there has been no recovery and they have been implicated pursuant to statement of the co-accused as also the alleged phone calls which are the foundation for their association with the principal accused. Be that as it may, having considered that the petitioners surrendered before the jurisdictional court and that there has been no recovery from them, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., Alomgir Mondal @ Alamgir Mondal and Nur Alom Mondal @ Toni shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act, Berhampore, Murshidabad.
If on bail, the petitioners shall not leave the jurisdiction of the district of Murshidabad and shall make
themselves available on each and every date so fixed by the learned Trial Court.
The application for bail, being CRM (NDPS) 1386 of 2025, is, thus, disposed of.
Report so submitted by the learned advocate appearing for the State be kept with the record.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
