Vs.

The State of West Bengal & Ors.

Mr. Anup Dasgupta, Mr. Somnath Bhattacharjee, Ms. Sharmistha Paul, ...for the petitioners.

Mr. Chandi Charan De, Mr. Anirban Sarkar, ...for the State.

It is submitted on behalf of the petitioners that they have been using a piece of land located between the Mouzas Kulpara and Uttar Purushottampur for a considerable period of time and title to the said land is not claimed by any person. The petitioners pray for a direction upon the respondent authorities to survey the excess land and include the same in the Mouza map by creating a new Dag as a Government land so that the said land can be used as a Government property. The petitioners submitted a representation in this regard before the competent authority on 19th June, 2019. The petitioners pray for a direction to consider the said representation at the earliest.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the fourth respondent to consider and dispose of the representation submitted

by the petitioners dated 19th June, 2019 within a period of two months from the date of communication of this order after affording reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law.

With such directions, WPA 22736 of 2019 is disposed of. However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
