Present petition has been filed challenging the order dated 25th July, 2025 passed by learned Additional Sessions Judge, Fast Track Court - III, Howrah whereby the learned Sessions Judge dismissed the revision petition being Criminal Revision No. 10 of 2023 assailing the order dated 31st December, 2022 of learned Judicial Magistrate, 1st Class, 5th Court, Howrah, whereby the evidence of complainant was closed.

Learned counsel for the petitioner/accused at the very outset has very fairly stated that there is some delay caused on the part of the petitioner, however, learned counsel submits that for the purpose of final adjudication the evidence may be allowed to be completed and some directions may be issued for completion of proceedings in time bound manner.

The court has considered the submissions. The revisional jurisdiction of the court is very limited. The Court can interfere into the order challenged before it if only there is some irregularity, illegality infirmity or perversity in the order challenged. This court cannot substitute its opinion with the opinion of the learned Sessions Court, merely because another view could not be taken. Learned Sessions Judge has examined the matter in right perspective and has rightly hold that there was lack of diligence on the part of the petitioner and delaying tactics was adopted. There cannot be any doubt that the crossexamination of witness is a solemn right however, this right cannot be unbridled or unfettered. Expeditious trial is the need of the urge. The litigants who cause unnecessary delay cannot be given further leniency.

The Court do not find any infirmity or illegality in the order of the learned Court below.

This revision petition is dismissed.
