The petitioner's prayer for transfer on selfmedical ground is pending consideration at the end of the District Primary School Council, Bankura. 3.

Without going into the merits of the application, the instant writ petition is disposed of by directing the Chairman-in-Charge, District Primary School Council, Bankura to consider the said application in accordance with law, at the earliest, but positively within a period of 90 days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioners immediately thereafter.

The authority shall consult the report of the Chief Medical Officer of Health prior to taking a decision on the petitioner's application.

Learned advocate for the petitioner is directed to forward a copy of the application along with all supporting documents in support of the prayer for transfer to the aforesaid respondent at the time of communicating the order of the Court.

It is made clear that suspension of Utsashree portal will not stand in way of the respondent authority to consider the transfer application of the petitioner.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
