(VIA VIDEO CONFERENCE) Mr. Robiul Islam Mr. Raju Mondal ....for the petitioner Mr. Soumitra Bandyopadhyay Mr. Priyabrata Batabyal ...for the State The petitioner complains that his land has been utilised for erection of a water tank by the Public Health Engineering Department but the Department has neither acquired the said land, nor forwarded any proposal for direct purchase of the same. The petitioner submitted a representation before the respondent no. 5 to that effect on August 21, 2015 which is yet to be considered. Having considered the submissions made on behalf of the parties and materials on record, I dispose of the writ petition with a direction upon the respondent no.

5 to consider and dispose of the representation filed by the petitioner on August 21, 2015 after giving a reasonable opportunity of hearing to all the affected parties including the petitioner, within a period of two months from the date of receipt of this order, in accordance with law. With the above observations and directions this writ petition being WPA No. 24683 of 2015 is disposed of. There shall be, however, no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties on usual undertakings. (Suvra Ghosh,J)
