Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statements of a co-accused.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She relies on the case diary and the report and submits that numerous phone calls were made between the present petitioner and the principal accused before the date of occurrence and until the principal accused was arrested. Considering the incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected.
