Petitioners addressed a complaint to the Commissioner of Police, Howrah Police Commissionerate as the private respondents were not allowing the petitioners to enter the property nor they were paying any rent towards the machines neither they were returning the machines. Learned advocate for the State has submitted a report prepared by the Inspector-in-Charge, Liluah Police Station which reflects that an agreement was entered into by and between the parties, a sum of Rs. 1,98,000/- was handed over.

I have considered the tenor of the writ petition and prima facie, I am of the view that nature of dispute complained of is to be adjudicated by a Civil Court. Accordingly, petitioners would approach before the Jurisdictional Civil Court for appropriate remedy as prayed for both regarding egress and ingress as well as rentals relating to the plant and machineries.

No interference is required from this Court.

With the aforesaid observations, the instant writ petition being WPA 25390 of 2024 is disposed of. Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
