Pursuant to the order so passed on 17th October, 2023 learned Advocate for the State appears.

Affidavit-of-service so filed be kept with the record. Grievance of the petitioner is the manner in which there is progress in the proceedings.

According to the learned Advocate charges were framed on August, 2022 and the next date was fixed in the year 2023. None of the witnesses turned up, and the Court was pleased to fix September, 2024 as the next date.

Having regard to the fact the case was registered in the year 2019, I direct the trial Court to fix at least one date in every 45 days for the purpose of recording evidence in the present case being Bally Police Station case no. 45/2019. In case any witness do not appear the learned Magistrate would directly sent notice to the

Officer-in-charge or Inspector-in-charge of Bally Police Station who would through an officer execute the process so issued by the Court and submit a report regarding the availability of the witnesses concerned.

No unnecessary adjournment should be granted to either of the parties.

The learned Public Prosecutor conducting the case would produce materials, documents, exhibits on the date so fixed for examination of witnesses.

All stakeholders would cooperate with the learned trial Court to conclude the trial at the earliest.

With the aforesaid observations CRR 4055 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
