Petitioner prays for bail.

Learned Advocate appearing for the petitioner submits that the petitioner is in custody for one year three months. He submits that none of the prosecution witnesses so far examined at the trial implicates the petitioner.

Learned Advocate appearing for the State submits that there are thirty five witnesses which are named in the charge-sheet. Five were examined. She draws the attention of the Court to the materials in the case diary.

Materials placed on record implicate the petitioner in murder. Trial is in progress. All prosecution witnesses are yet to be examined. At this stage it would be presumptuous to hold that the petitioner is not implicated in the charges, on the basis of the prosecution witnesses so far adduced.

Considering the gravity of the offence, the materials available on record, the period of custody of the petitioner and the fact that the trial is in progress we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected. 7.

C.R.M.(DB) No. 3499 of 2024 is dismissed.
