Mr. Sanatan Panja ... for the State-respondent(s) The genesis of the present writ petition relates to a matrimonial discord, pursuant to which Beniapukur P.S. Case No. 163 of 2024 dated 03.10.2024 was registered for investigation under Section 85/316(2)/3(5) of the BNS read with Section 3&4 of the D.P. Act.

A Supplementary Affidavit was filed in course of hearing of the writ petition, wherein, list of articles which were handed over subsequent to the marriage which included costly jewelleries and were kept in a locker, was brought to the notice of this court.

Government Advocate, appearing on behalf of the State has submitted a report which reflects that a notice under Section 94 of the BNSS has been served to the Branch Manager of ICICI Bank, CIT Road Branch, wherein the concerned Bank has informed regarding the gold ornaments which were kept as mortgage with the Bank.

The police authorities would inform the bank not to deal with the said gold jewelleries in other manner except, without the permission of the learned ACJM, Sealdah, who is in seisin of Beniapukur P.S. Case No. 163 of 2024.

The report also contends regarding the issues relating to anticipatory bail and/or bail obtained by the private respondents. Since the principal grievance of the petitioner regarding the police inaction has been addressed, I am of the view that rest of the issues would be considered in course of the investigation by the jurisdictional court and/or during the

course of trial.

With the aforesaid observations, WPA 25327 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.
