18.07.2023 Item No.10 Court No.18 AJ.

W.P.A. 24919 of 2022 Munni Devi -Vs- The State of West Bengal & Ors.

Mr. Bidyut Kumar Halder, Mr. Indranil Halder, Ms. Srabanti Das, Ms. Neha Singh.

.....for the petitioner.

Mr. Malay Singh, Mr. Bibekananda Tripathy.

......for the State.

The father-in-law of the petitioner was a Group-D employee of Alipore Takshal Vidyapith, Kolkata.

The petitioner is praying family pension.

Mr. Singh, learned Counsel for the State respondents files the report bearing Memo No. 277/Law dated July 06, 2023 of the District Inspector of Schools (S.E.), Kolkata, the respondent no.3 herein, let the said report be kept with the record.

The said report suggests that the concerned employee died on March 26, 1977 and he was under the C.P.F. Scheme, as such the petitioner is not entitled to the family pension, as prayed for. In view of the above, the prayer of the petitioner is misconceived; accordingly W.P.A. 24919 of 2022 is dismissed without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
