1. The petitioner claims to be the headmaster of a school. His allegation is that some of the teachers impleaded as private respondents in the writ petition, are creating disturbance in the smooth functioning of the school activities.
2. A complaint was made before the West Bengal Board of Secondary Education and also before the District Inspector of Schools (SE), Purba Bardhaman.
3. The Deputy Secretary (Disciplinary Authority) of the West Bengal Board of Secondary Education requested the District Inspector of Schools to forward a report to the Board with utmost priority for the interest of the students as well as for the institution after conducting a preliminary investigation into the matter.
4. It has been submitted that the investigation has not been conducted till date. The school and the students both are suffering.
5. Prayer has been made to direct the authorities to take a decision in the matter.
6. Learned advocate representing the private respondents opposes the submission made on behalf of the petitioner. It has been submitted that the academic council of the school has not been constituted till date.
7. From the submissions made on behalf of the parties and on perusal of the materials on record, it appears that there is serious infighting between two groups of teachers in the school. Such infighting may directly hamper the education imparted to the students.
8. For ends of justice and in the interest of the school and its students, the Court directs the concerned District Inspector of Schools, Secondary Education to conduct a preliminary inquiry in terms of the request made by the Board at the earliest.
9. The District Inspector of Schools shall take steps to ensure that the functioning of the daily activities of the school including taking classes by the teachers is not jeopardized by any person whatsoever.
10. The Board is also directed to ensure that the school functions in a proper manner and the atmosphere of the school is congenial for the students.
11. A decision shall be taken by the authorities in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.
12. As an interim measure, the authority may consider appointment of an administrator for running the day to day affairs and activities of the school.
13. The writ petition stands disposed of.
14. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
