WPA 24735 of 2025 (Banashree Das vs. State of West Bengal & Ors.) Mr. Samrat Banerjee .... For the Petitioner Mr. Sujoy Mondal .... For the State Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. None appears for the private respondents despite service.

The petitioner alleges that the private respondents attacked her husband and brutally assaulted him. When the petitioner went to rescue him, she was also assaulted. Complaints lodged by the petitioner were not considered by the police authority.

It appears from the report submitted by the State that both the complaints lodged by the petitioner have been registered. The first complaint has culminated in submission of charge sheet. Investigation is going on with regard to the second complaint.

In view of the fact that investigation is in progress pursuant to the second complaint lodged by the petitioner, the investigating officer is directed to conduct a fair and impartial investigation and take the same to its logical conclusion in accordance with law.

In the meantime, the police authority shall maintain vigil over the area and ensure maintenance of peace and tranquility.

The writ petition is accordingly disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
