Kutubuddin For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Bhatpara Police Station Case No. 195 of 2019 dated 25.09.2019 under sections 376D/506 of the Indian Penal Code.

Mr. Kar, learned advocate appearing for the petitioner submits that considering the statement of the victim girl, as recorded under section 164 of the Code of Criminal Procedure, a co-ordinate Bench of this Court granted interim bail to the petitioner on 16th December, 2019. Subsequent thereto, the petitioner herein had married the victim girl and such marriage was registered on 5th October, 2020 and presently they are residing together peacefully. A copy of the marriage registration certificate, as produced, be kept on record.

Ms. Khan learned advocate appearing for the State has placed before us the case diary, including the Ossification Test report wherein it has, inter alia, been observed "approximate BONE AGE of Rani Oraon

D/o Ajay Oraon, H/F is 17 years to 19 years (seventeen years to less than nineteen years) .

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary and the fact that the petitioner and the victim girl had married, we confirm the interim bail as granted on 16th December, 2019.

The application for bail, being CRM No. 11572 of 2019, is disposed of.
