Subir Singha v. State Of West Bengal
08.01.2024 Item No.124 Ct. No. 29 CHC Rejected C.R.M.(A) 4730 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Malda Police Station Case No. 435/23 dated 03.08.2023 under Section 408 of the Indian Penal Code.
And In the matter of : Subir Singha ...... petitioner Mr. Kazi M. Rahman ....for the petitioner Mr. Debasish Roy, Ld. P.P.
Mr. Navanil De ....for the State Petition is taken up for consideration subsequent to the order dated October 17, 2023, passed by a coordinate Bench. By such order, coordinate Bench granted interim anticipatory bail to the petitioner.
It is submitted at the bar that, such order was passed without consulting the materials in the Case Diary and in view of the ensuing Puja Vacation.
We perused the materials in the Case Diary.
Learned advocate appearing for the petitioner submits that, the petitioner was false implicated. Petitioner also filed a police complaint against the school authorities. The materials in the Case Diary suggest that, the petitioner was engaged by school as a cashier. He apparently
took money from the members of the public for the purpose of admitting students in the school.
In view of the involvement of the petitioner in such incident as transpiring from the materials in the Case Diary, we are unable to confirm the interim order dated October 17, 2023 or grant anticipatory bail to the petitioner. This application for anticipatory bail is, thus rejected. CRM(A) 4730 of 2023 is disposed of.
