The petitioner is seeking compassionate appointment as his father, a permanent employee under the Government of West Bengal, Directorate of Micro and Small Scale Enterprises died in harness on 1st January, 2003. The compassionate appointment relates to matters concerning recruitment to any civil post under the State. In view of the provisions of Section 15(a) of the Administrative Tribunals Act, 1985 this Court does not have the jurisdiction to receive, try and determine a writ petition concerning compassionate appointment in respect of a civil post under the State.

The writ petition is, accordingly, dismissed as withdrawn with liberty to file afresh before the appropriate forum in accordance with law if otherwise entitled to.
