Learned counsel for the petitioner submits that the petitioner has been running business in the name of his wife in the shop room in question. The private respondent restrained him from running the said business and coerced him to pay Rs.2,00,000/-. Despite paying such amount, the private respondent again obstructed his business and threatened him with dire consequences. The petitioner apprehends he shall not be able to continue with his business any further.

The private respondent denies and disputes the allegation made by the petitioner. Learned counsel for the private respondent submits that the private respondent is residing in Dubai at present and working for gain there. By virtue of family settlement the petitioner was given possession of the shop room in question subject to payment of Rs.10,00,000/- to the private respondent in cash and by cheques. The petitioner paid Rs.2,00,000/- in cash and issued 8 post dated cheques for the remaining amount in favour of the private respondent.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the petitioner is admittedly running business in the shop room in question, the police authority shall keep strict vigil in the area and render necessary assistance/protection to the petitioner as and when sought so that he is able to continue with his business therein.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
