In terms of order dated 29th November, 2024 a report dated 17th January, 2025 prepared by the District Inspector of Schools (SE), Purba Bardhaman being respondent no. 5 is placed before this Court and same is taken on record.

From the said report it appears that a medical report dated 12th April, 2022 issued by the Zonal Medical Board, Burdwan Medical College and Hospital, Purba Bardhaman was forwarded to the Chief Medical Officer of Health, Purba Bardhaman by the Medical Superintendent cum Vice Principal, Burdwan

Medical College and Hospital vide memo dated 13th April, 2022.

On perusal of the report, it appears that petitioner was advised to perform limited physical movement and restricted journey. Since vide report dated 12th April, 2022 petitioner has been advised to avoid long journey, respondent no. 5 is directed to forward the transfer application of the petitioner along with medical report to the West Bengal Central School Service Commission by fortnight from the date of communication of this order. On receipt of transfer application along with medical report, Chairman of West Bengal Central School Service Commission is directed to take decision on transfer application of the petitioner in accordance with law by four weeks thereafter and the decision to be taken by the Chairman of the Commission shall be communicated to the petitioner by ten days thereafter.

It is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

Writ petition stands disposed of, without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
