Supplementary affidavit and affidavit-of-service filed in Court today are taken on record.

The petitioner is aggrieved that Egra Police Station has not taken steps to register the FIR in respect of a complaint regarding the unnatural death of her daughter-in-law, namely, Mousumi Manna. Counsel for the petitioner submits that since after the incident, the local villagers barged into their residence, ransacked the house and threw out the petitioner and her family. He further submits that the petitioner and her family comprising of men, women and children are roaming around in the street. Counsel for the State submits that FIR No. 615 of 2022 dated 24.08.2022 under Sections 341/325/308/427/506/34 of the Indian Penal Code has been registered and investigation is on.

The Inspector-in-charge, Egra Police Station on a complaint received from the husband of the petitioner in this regard, had diligently assisted the petitioner and her family to return to her residence thereafter, the writ petitioner and her family were once again thrown out of their residence by local villagers. While recording appreciation for the action already taken by Egra Police Station, this Court, in the facts and circumstances of the case, directs the Inspector-in-charge, Egra Police Station to assist the petitioner and her family once again to enter into her premises and a police picket to be posted outside the petitioner's residence for a period of one week from date.

The Inspector-in-charge, Egra Police Station shall continue to maintain a strict vigil over the area and warn the villagers that the investigation into the death of Mousumi Manna is on under the FIR aforementioned.

If considered necessary, Egra Police Station shall not hesitate to register an FIR against the villagers concerned, who have forcibly dispossessed the petitioner and her family from their residence. It shall be ensured by the Inspector-in-charge, Egra Police Station that the petitioner and her family members are able to reside in the residence peacefully without being disturbed by any of the local villagers.

Let the FIR No. 615 of 2022 dated 24.08.2022 be investigated into, as expeditiously as possible and be completed within a period of three months from date. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
