1. Affidavit of service filed in Court today is taken on record.
2. The petitioner has approached this Court praying for a direction upon the respondent no. 2, the headmaster of Panchagram I S A High School for changing the name of the petitioner in the official records of the school.
3. It appears that the petitioner by the name of 'Beli Khatun' took admission in the Panchagram I S A High School and she studied in the school from 2005 onwards till appearing in the Madhyamik Examination in the year 2012.
4. The mark-sheet of the petitioner issued by the West Bengal Board of Secondary Education clearly indicating her name, roll number and year is annexed to the writ petition.
5. For reasons best known, the petitioner has annexed a transfer certificate from one Kolan P.B. Vidyapith (High School) dated 10th February, 2011 which mentions that she passed the annual examination of Class-VIII for promotion to Class-IX in February, 2010.
6. She intends to change her name from 'Beli Khatun' to 'Ajija Rohman'.
7. Learned advocate representing the school produces before this Court the admission register to show that the said Beli Khatun daughter of Ujir Shaikh took admission in the year 2005 and she passed the Madhyamik Examination in the year 2012.
8. It has been submitted that the transfer certificate dated 5th February, 2011 is a fake one as the same could not have been issued by the Kolan P.B. Vidyapith (High School) as the petitioner did not study in the said school at all.
9. On a perusal of the writ petition, it appears that the State of West Bengal has been wrongly described to be represented through the President, West Bengal Board of Secondary Examination. The prayer in the writ petition is also absolutely misconceived.
10. Upon hearing the submissions made on behalf of the petitioner and upon perusal of the averments made in the writ petition and the documents annexed thereto, the Court is convinced that the instant writ petition is an utterly misconceived one and is liable to be dismissed in limine with costs.
11. The writ petition accordingly stands dismissed.
12. Considering the submission made by the learned advocate for the petitioner, costs is not being imposed.
13. The documents produced by the learned advocate representing the school be retained with the records.
14. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
