.....For the Respondents State Today the writ petition appears under the heading "To Be Mentioned" at the instance of the learned senior State counsel Mr. Soumitra Bandyopadhyay. In the notice dated November 11, 2024, served upon the learned Government Pleader by Mr. Samrat Chakraborty, learned advocate, it was specifically mentioned that, the writ petition shall be moved before this Court as listed motion on November 13, 2024 or so soon thereafter as and when the business of the Court may permit. A copy of the said notice is taken on record.

The writ petition appeared under the heading "Motion (Land)" on November 11, 2024 when relying upon the learned counsel appeared for the petitioners this Court considered the writ petition in absence of the respondents recording that, despite notice the respondents did not appear but it was never pointed out

before this Court that, the notice was served upon the learned Government Pleader specifically mentioning that, the writ petition shall be moved on November 13, 2024. The writ petition was also disposed of on that day. This Court does not appreciate this practice and always expects a fair submission.

In view of the above, the order dated November 11, 2024 stands recalled.

The writ petition, WPA 25475 of 2024, shall appear under the heading "Motion (Land)" in the Combined Monthly List of March, 2025.
