Petitioner is in custody for one year. He submits there is no direct evidence connecting him with the crime. Learned Advocate for the State opposes the prayer for bail. He submits petitioner was last seen with the victim and thereafter the dead body was recovered.
We have considered the materials on record. Petitioner was not only seen with the deceased prior to his death but one of the offending weapons i.e. chopper was recovered on his leading statement. Post mortem report shows victim suffered sharp cutting injuries. Personal belongings of the victim were recovered from co-accused along with another chopper. In view of the aforesaid incriminating materials and gravity of the offence, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
