Ms. Malini Chakravarty Ms. Shampa De ...for the petitioners This is an application under Article 227 of the Constitution of India praying for a direction upon the learned Civil Judge (Jr. Divn.), 2nd Court, Alipore to dispose of the Ejectment Suit No.39 of expeditiously.

Record reveals that by an order dated April 18, 2024 the written statement was accepted and June 10, 2024 was fixed for framing of issues.

The learned advocate appearing for the petitioner submits that till date the issues have not been framed though suggested issued have been filed by the learned advocates for the respective parties.

In view of the order sought and proposed to be passed there is no necessity to issue any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or their learned advocates appearing before the learned Trial Judge.

In the light of the submissions made by the learned advocate for the petitioner, CO 3659 of 2024 is disposed of by requesting the learned Civil Judge (Jr. Divn.), 2nd Court, Alipore to dispose of the suit as expeditiously as possible without granting any unnecessary adjournments to either of the parties as the suit is for eviction and filed sometimes in the year 2014. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
