Learned advocate also submits that although, charge-sheet has been submitted and charge has been framed but out of the 12 witnesses proposed to be examined by the prosecution, till date, none of the witnesses have been examined.

Learned advocate for the State has drawn the attention of the Court to the statements of the witnesses, particularly, the statement under Section 164 of the Cr.P.C. Prima facie, there are materials appearing against the petitioner. However, the same is in an abstract form. Be that as it may, having regard to the period of detention of the present petitioner, I am of the view that

further custodial detention of the petitioner, at this stage, is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Saidul Sk. shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned ACJM, Jangipur.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Murshidabad without prior intimation to the learned trial court.

In case, there is any violation of the aforesaid conditions, the trial court would be at liberty to cancel the bail without further reference to this court. Accordingly, CRM(M) 2215 of 2025 is allowed.
