Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner lodged an FIR alleging that one of her sons had misappropriated her property. However, after purported investigation, a final report was submitted. No statement of the victim was recorded under Section 164 of the Code. This has been challenged by filing a protest petition before the learned trial Court.

Learned counsel appearing on behalf of the State relies on the report and submits that necessary documents were seized during investigation including a deed of gift. After completion of a thorough investigation, a final report was submitted, which h is under challenge.

It appears that the outcome of investigation has already been challenged by filing a protest petition. It is quite surprising that the petitioner has again sought similar relief

before this Court.

Let the learned trial Court dispose of the protest petition expeditiously and in accordance with law. No further order need be passed in this regard. With these observations, the writ petition is disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
