Case No. 65 of 2021 dated 30.4.2021, wherein charge-sheet has been submitted against the accused persons under sections 147/148/149/326/307 of the IPC. The case is of the year 2021 and is yet to be committed to the court of Sessions.

Ld. Advocate appearing for the petitioners/appellants submits that on different pretext and in a designed manner, adjournments are being sought for and granted. In view of the submissions so made and the fact that more than 35 months have been consumed since the initiation of the case, I direct the ld. Trial court to take steps for committal of the case to the ld. Sessions Court on the next date so fixed or within a fortnight thereafter.

In case, any accused is delaying the trial and is not appearing, the ld. Trial court would exhaust harsher process of law, if required cancel the bail after issuing notice and, thereafter commit the case in respect of the accused persons, who are appearing before the Court.

It is reiterated that within 15 days from the next date so fixed, the ld. Trial court would be at liberty to fix number of dates but will not stretch the timeline for committal of the case.

With the aforesaid observations, CRR 4072 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
