PB Sl. No.44.

Ct. No.655.

WPCRC 56 of 2025 In WPA 14873 of 2023 Ranjit Halder & Ors.

Vs.

Mrs. Manarama Middya (Pandit) The Pradhan, Sree Nagar Gram Panchayat Mr. Salil Maiti, Ms. Anima Maiti, Ms. Debjani Roy.

... For the petitioners.

Mr. Lalit Mohan Mahata, Md. Ahsanuzzaman.

... For the alleged contemnor.

1.

Learned advocate representing the alleged contemnor is present.

2.

Learned advocate for the writ petitioner is also present.

3.

An application was taken out at the behest of the writ petitioner with a prayer for considering his representation filed before the Pradhan of Sree Nagar Gram Panchayat. The matter was heard and the direction was given upon the Pradhan of Sree Nagar Gram to consider the representation filed by the writ petitioner and pass a reasoned order. Despite the order passed by this Court and communicated to the alleged contemnor, she did not venture to comply it.

Thereafter, an application for contempt was filed at the behest of the petitioner and the notice of the said petitioner was served upon the alleged contemnor, despite receiving the same, she did not venture to appear before the Court. Thereafter, Rule was issued by this Court against the alleged contemnor. The Rule was duly served upon the alleged contemnor but she was not present before the Court. Ultimately the concerned Police Station was directed to secure the presence of the Prodhan before the Court.

4.

It is specifically stated that the alleged contemnor being the Pradhan of Sree Nagar Gram Panchayat has deliberately and willfully disobeyed the order passed by this Court on 3rd April, 2025, and sat idle over the matter and did not venture to adhere the direction passed by this Court.

5.

The concerned police station was directed to ensure presence of the said Pradhan before the Court and the Pradhan appeared and Advocate was engaged to represent her in this case. Their affidavit of compliance was filed on behalf of the alleged contemnor stating that the direction as passed by this Court has already been complied with and the representation made by the petitioner before her has already been disposed of after giving opportunity of hearing to the parties.

6.

I have gone through the Affidavit-in-compliance filed by the alleged contemnor and exception to that

filed by the writ petitioner and it appears that the direction passed by this Court has already been complied by the alleged contemnor.

7.

So, there is nothing remain in this case.

8.

Accordingly, the instant contempt application being WPCRC 56 of 2025 is disposed of.

9.

Urgent certified copy of this order, if applied for, shall be given to the parties, upon compliance of all requisite formalities.
