The writ petitioners, apprehending that IDFC Bank is likely to attack his property, have approached this Court.

It is submitted that there are certain persons, who may have fraudulently charged the petitioners' property with the IDFC Bank.

Learned counsel for the State submits that the bank is interested in "B" series property whereas the petitioners own property located in "C" series. The writ petition, apart from being premature is thoroughly misconceived, is even otherwise not maintainable since the petitioners have an effective alternative remedy in the event of any actual steps taken by the bank under the provisions of the concerned Statute.

In those circumstances, the writ petition shall stand dismissed with costs assessed at Rs.2,500/- payable to Haridevpur Police Station by the petitioner. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
