1. Petitioner has come before this Court with a grievance that Sankar Tola Ghat situated at the riverbank is not being properly maintained by the Irrigation & Waterways Department and as such, villagers are suffering at large due to collossal damage of embankment. To that extent, the petitioner filed a representation dated 22nd August, 2025 before the concerned authorities including the Additional Chief Secretary, Irrigation & Waterways Department and the Principal Secretary, Public Health Engineering Department. However, no

reply has been received, as of now resulting filing of this present Public Interest Litigation before this Court.

2. Learned State Counsel raises no objection if the representation is being directed to be considered by the concerned authority.

3. Heard the submission of learned counsels appearing for the parties, perusal the entire materials on record. It transpires that the representations were made before the various authorities but the State respondents failed to give any reply regarding the fate of such application. It is the bounden duty of the appropriate authority to dispose of the representation after giving an opportunity of personal hearing to the petitioner as well as other affected parties, if any.

4. In view of that the instant PIL is disposed of with a direction to the respondent no.4 to dispose of the said representation, as submitted dated 22.08.2025 within a period of eight weeks by passing a speaking and reasoned order.

5. It is pertinent to mention herein that we have not expressed any view regarding merit of this case.

6. Thus, PIL stands disposed of.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
