The petitioner applied for compassionate appointment on the death of his father who died in harness on January 9, 2005. The father of the petitioner was late Basanta Maji who was a gram panchayat karmee of Moynapur Gram Panchayat.

It appears that the petitioner applied in the prescribed format. The case of the petitioner was considered and recommended. The petitioner was enlisted at Sl. No. 737 by the concerned department. The Commissioner, Panchayats and Rural Development, West Bengal sent the proposal for appointment of the petitioner on compassionate ground to the Joint Secretary to the Government of West Bengal, Department of Panchayat and Rural Development, for necessary action in the said proposal as well.

It is clear that a proposal has been sent and the petitioner's name appears at Sl. No. 737 in the

list. The petitioner has not yet been informed about the fate of such proposal/recommendation.

Under such circumstances, the writ petition is disposed of with a direction upon the Joint Secretary to the Government of West Bengal, to pass an order intimating the petitioner as to whether the petitioner has come within the zone of consideration for appointment on compassionate ground, as per his serial number.

The authority shall also indicate the serial number of the last candidate who had been recommended and subsequently appointed by the authority under the died in harness category. Needless to mention, if the vacancies are available as per the seriality, necessary steps shall be taken to appoint the petitioner in accordance with law.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

This court has not entered into the merits of the allegations and the entire issue shall be decided independently.

A copy of the writ petition along with the server copy of this order be served upon the Joint Secretary to the Government of West Bengal, Department of

Panchayat and Rural Development for necessary action.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
