14.12.2022 Court No.21 Item No.141 AP WPA 25001 of 2022 Tarun Ghosh and Ors.

Vs.

The State of West Bengal and Ors.

Mr. Lal Ratan Mondal ... For the Petitioners.

Ms. Sudipa Ray Mr. Srinath Singha Roy ... For the State.

The petitioners' prays for disposal of their representation dated November 03, 2022 by the Superintendent of Police, Murshidabad.

The petitioners' case is that they have not been engaged as Civic Volunteers instead of Traffic Wardens (the post in which they are currently engaged), but various other people who worked as Traffic Wardens have been engaged as Civil Volunteers in the said police station. From a report filed in Court, it appears that 126 Traffic Wardens were engaged in 2016. From the pay role of the month of August 2016 it appeared that not all the writ petitioners' names were recorded therein. Mr. Mondal, learned counsel appearing on behalf of the petitioners disputes such position. He submits that the petitioners were on the pay role. Having considered the submissions of the parties and the material placed on record, the Superintendent of Police, Murshidabad is directed to dispose of the representation of the petitioners dated November 3, 2022 by giving a personal hearing to the

petitioners within eight weeks from date. Let the representation be disposed of by way of a reasoned order. Let the reasoned order be communicated to the petitioners within two weeks of passing thereof. With the directions aforesaid, WPA 25001 of 2022 is disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
