Learned counsel for the petitioner states that inadvertently he has made on incorrect statement on 15th May, 2024, wherein he had sought liberty to make concerned District Magistrate as a partyrespondent. Learned counsel for the petitioner states that concerned District Magistrate is already a party in the present writ petition. His earlier statement made as reflected in the order dated 15th May, 2024 was an inadvertent mistake on his part.
In view of the same, earlier order dated 15.05.2024 is recalled.
With the consent of the parties, the present matter is taken up for hearing.
The petitioner was a 'panel pleader' before the learned District Court.
The petitioner has preferred the present writ petition seeking reimbursement of his outstanding
bills. The petitioner, at the outset, states that he shall be satisfied if the present writ petition be treated as a representation before the concerned District Magistrate to clear his outstanding dues.
Learned counsel for the respondent no. 1 has handed over a copy of the instruction wherein it is stated that the concerned District Magistrate is the appropriate authority to disburse the profession fees of empanelled advocates.
In view thereof, this Court directs respondent no. 3 to treat this writ petition as a representation and give a personal hearing to the petitioner concerned within a period of four weeks from the date of communication of this order and pass an appropriate speaking order. Copy of the order shall be provided to the petitioner. Needless to state that if the petitioner is aggrieved by the said speaking order he shall be at liberty to challenge the same in accordance with law. With the above direction, the present writ petition is disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
