The prayer of the petitioner seeking transfer was considered by the Commission and a communication has been made to the petitioner on 19th June, 2025 mentioning that the rank of the petitioner in his preferred school is 'four'.

The Court has not been made aware as to whether the other three candidates ranked above the petitioner are interested to join the subject school or not.

The Commission is directed to grant an opportunity of hearing to the petitioner and other three candidates ranked above him to ascertain as to whether

anybody is interested to join the vacancy in Malda Academy High School.

If none is willing to join the school, then the petitioner may be recommended for joining in the said school.

If the vacancy at the above school is not available, then the petitioner shall be provided the names of the schools where there are vacancies for accommodating the petitioner near to his residence. 7.

A decision shall be taken by the Commission at the earliest, but positively within a period of twelve weeks from the date of communication of this order. 8.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

10. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
