Ms. Somoshree Saha ...For the Petitioner Mr. Ajit Kumar Mishra Mr. Ashok Halder Mr. Abhishek Dey ....For the Respondents Under challenge in the present writ petition is an order dated November 17, 2022 passed by the Disciplinary Authority. The petitioner was dismissed from service. The petitioner was employed as a Sub-Inspector with the Border Security Force (BSF).

The petitioner preferred a statutory appeal on February 6, 2023.

It is the grievance of the petitioner that till date such appeal has not been disposed of.

Mr. Mishra, learned counsel appears on behalf of the Union of India.

Considering the rival submissions of the parties and the materials placed on record, this Court directs the appeal dated February 6, 2023 be disposed of within a period of two months from date, in accordance with law.

With the directions aforesaid, W.P.A. 24414 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all the formalities.
