For the respondent no.8 The petitioner complains of police inaction on the ground that the complaint lodged by the petitioner as against the respondents no.8 to 16 before Krishnanagar Police Station on 24th February, 2019 on being transferred to Survey Park Police Station under Kolkata Police, no steps have been taken for carrying forward the investigation.
By an order dated 8th March, 2021, a report in the form of an affidavit indicating the steps that have been taken by the concerned police station and the investigating officer after the complaint stood transferred to Survey Park Police Station was directed to be filed.
In compliance of the said order, a report in the form of an affidavit affirmed by the Deputy Commissioner of Police, East Division, Kolkata, on 22nd March, 2021, is filed in Court today. The same is taken on record. After perusing the report, I am satisfied that the police is carrying on the investigation and, as such, it cannot be said that the police authorities are sitting idle over the complaint as alleged by the petitioner. I find no ground of police inaction substantiated in the matter. The writ petition is, therefor, disposed of directing the police authorities to conduct the investigation in a fair and transparent manner following the provisions of law as required on an expeditious basis. I am also not inclined to fix any outer limit for concluding the investigation considering the volume of bank accounts involved in the matter as indicated in the said affidavit which are to be scrutinised and further information that may be required to be collected. This exercise in connection therewith cannot be done on a time-bound manner.
Considering the fact that the investigation is continuing, I am not inclined to allow a copy of the affidavit filed by the Deputy Commissioner of Police, East Division, Kolkata, on 22nd March, 2021 today to be made over to any of the parties at this stage.
The department is directed to keep the affidavit in a sealed envelope with the learned Registrar General of
this Court and no certified copy thereof be issued to any of the parties without the leave of Court.
Nothing further remains to be adjudicated in this writ petition.
In view of disposal of the writ petition, no further order is required to be passed in the connected application, being CAN 1 of 2021, which also stands disposed of accordingly.
There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, is to be given to the parties, upon compliance of necessary formalities.
