The petitioner alleges that, although the municipal records classify the said premises as a factory, no factory exists or operates at the location.

The petitioner further contends that despite having made representations to the authorities of the Kolkata Municipal Corporation for correction of the relevant assessment book, no corrective action has been undertaken. In light of the foregoing, I am of the view that the

respondent authorities ought to consider the petitioner's representations and pass an appropriate order in accordance with law.

Accordingly, I dispose of this writ petition with the following directions:

a) The Chief Manager (Revenue) (North), respondent No. 4, shall conduct an inspection of the relevant premises, after giving due notice to the petitioner.

b) Upon completion of the inspection, respondent No. 4 shall issue a notice of hearing to the concerned parties and, after hearing the petitioner, shall assess the premises based on the inspection report.

c) A reasoned order shall be passed and communicated to the petitioner forthwith.

The entire exercise shall be completed within three months from the date of communication of this order. Accordingly, WPA 25679 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
