The petitioner claims that his peaceful possession along with his family members are being disturbed and they are subjected to harassment at the behest of the private respondents.

In spite of informing the same, no action has been taken by the police authorities.

I find that the police authorities have earlier registered a case and last of

the complaints referred to in the writ petition is of 4.10.2023.

Junior Government Advocate, appearing on behalf of the State, has submitted a report.

The report reflects that Raidighi P.S. Case No. 535 of 2023 was registered on 11.10.2023.

Having considered that the police authorities have taken steps, I am of the view that the purpose for which the writ petition has been filed, has been subserved. But, if the act and actions of the private respondents continues, I direct the petitioner to take out an appropriate application before the learned Judicial Magistrate in seisin of the said case, being Raidighi P.S. Case No. 535 of 2023.

The learned Court, if it thinks that the accused persons who are on bail, are

flouting the liberty of bail, then the Ld.

Magistrate in suitable and appropriate circumstances, would modify the order of bail and pass directions upon the private respondents and/or the accused/persons therein to stay outside the jurisdiction of Raidighi police station.

With the aforesaid observations, WPA 24422 of 2023 is disposed of.

Report so submitted be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
