Although the petitioner was not present before the Notary Public, power of attorney was purportedly executed on that date.

Learned counsel appearing on behalf of the petitioner submits that there are some incurable defects in the application for anticipatory bail. As such, the petitioner would not like to press the same and would instead file a proper application afresh. Accordingly, the application for anticipatory bail is dismissed as not pressed.

However, this order shall not preclude the petitioner from filing a proper application for anticipatory bail afresh on the self same grounds.

The appearance of the I.O. is noted and is dispensed with. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
