Affidavit-of-service so filed be kept with the record. Report submitted by Mr. Nandy, learned advocate appearing for the State be kept with the record. The subject matter of challenge was in relation to Kharagpur Local Police Station Case No.721 of 2022 dated 08.09.2022 under Sections 409/420 of the Indian Penal Code. Report reflects that final report was submitted in connection with the said case wherein the report under Section 173 of Cr.P.C. was submitted being Kharagpur (L) PS FR no.61/23 dated 31.01.23. The prayer of the Investigating Officer was to discharge the FIR named accused persons from this case as the same related to mistake of fact.

Having regard to the same, the revisional application becomes infructuous.

Accordingly, CRR 4160 of 2022 is disposed of as

infructuous.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
