IN THE HIGH COURT AT CALCUTTA

Item No.37 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.

Allowed C.R.M. (M) 2224 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Harishchandrapur Police Station Case No. of dated 15.05.2022 under Sections 302/201/120B/34 of the Indian Penal Code (G.R. Case No. 1178 of 2022).

And In Re :

Ruhul Amin ... Petitioner.

Mr. Sandip Chakraborty, Mr. Amanul Islam, Mr. Sourav Mukherjee, Mr. Kaustav Das, Mr. Gourav Roy, Mr. Raja Das ... For the Petitioner.

Mr. Bitasok Banerjee, Mr. Sourat Nandy ... For the State.

Learned advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused person viz. Obaidur Rahaman who has been granted bail on 16.10.2025 in CRM (M) 1826 of 2025.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the present petitioner is similarly placed as the other accused viz. Obaidur Rahaman.

Taking into consideration the period of detention of the present petitioner for 19 months and the fact that charge, till date has not been framed, I am of the view that the petitioner

be allowed to furnish his bond after the charges are framed as it has been informed that date has been fixed for consideration of charges on 29th January, 2026. Accordingly, with the aforesaid directions, the prayer for bail of the petitioner viz., Ruhul Amin is allowed. So far as the conditions are concerned, learned Trial Court would impose such terms and conditions as it deems fit and proper for ensuring the presence of the present petitioner in course of the trial.

The application for bail, being CRM (M) 2224 of 2025, is, thus, disposed of.

Report submitted by the learned advocate appearing for the State be kept with the record.
