Petitioner prays for bail as he is in custody for more than 10 months, although, charge-sheet has been submitted but there has no progress in the case as charges have not been framed till date.

Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized.

I have taken into account the materials appearing in the case, and I am of the view that Section 37 of the NDPS Act is attracted.

Having considered the same the prayer for bail of the petitioner in CRM (NDPS) 1394 of 2025 is dismissed.

Having regard to the facts of the present case, I direct the learned trial Court to overcome the stage of consideration of charges on the next date so fixed or within a week thereafter. All efforts be taken by the learned trial Court to examine the seizure list witnesses within a period of 60 days from the date of consideration charges.

Petitioner will renew his prayer for bail after the examination of the seizure list witnesses are over. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
