The genesis of the case relates to the order passed by the learned Executive Magistrate in the year 2012, although the petitioner is aggrieved by the rejection of the order relating to Section 5 of the Limitation Act, wherein the learned Sessions Judge, Uttar Dinajpur, while invoking his revisional jurisdiction was pleased to dismiss the application under Section 5 of the Limitation Act.

I have considered the original order passed by the learned Executive Magistrate, which relates to calling for reports from two authorities, firstly, the Officer-in-charge, Chakulia Police Station and secondly, from the BL & LRO, G-II. Having regard to the fact of the case, I am of the opinion that no cause of action has been created for any interference by this Court at this belated stage.

Accordingly, CRR 3447 of 2017 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

The petitioner would be at liberty to approach before the Court below with proper prayer.
