Being aggrieved by the order dated 14th August, 2024 the petitioners preferred the present application for setting aside the impugned order as well as all the subsequent orders. By the impugned order, the learned Court below have restrained the respondent nos. 1 to 3 from granting any new franchisee in the locality during the terms of agreement to the respondent nos. 4 and 5 or any third party and also restraining from creating any disturbance in running the business by the petitioners as described in the schedule of the property for a particular period.

It appears that the said order is interim in nature and the main injunction application is required to be disposed of at the earliest.

In such view of the matter, the application being CO 3660 of 2024 is hereby disposed of with a direction

upon the Court below to dispose of the injunction application preferably within a period of three weeks from the date of reopening of the Court after the Puja Vacation.

The order impugned passed by this Court shall not be given effect till the disposal of the injunction application.

It is also made clear that I have not gone into the merit of the issues involved in the present application and the court below will dispose of the main injunction application on merit, without be influenced by any observation made herein.

There shall, however, be no order as to costs. All parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. (Dr. Ajoy Kumar Mukherjee, J.)
