Report submitted by the State be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 1 month. The evidence of the victim and the de facto complainant is over. Learned advocate submits that considering the stage of the case further detention of the petitioner is unwarranted.
On the other hand, learned advocate appearing for the State opposes the prayer for bail.
Having considered the period of detention of the petitioner, the materials which have surfaced and the materials which are appearing in the case diary, I am of the view that further detention of the petitioner is unwarranted.
Accordingly, the prayer for bail of the petitioner is
allowed. The petitioner, namely, Subrata Biswas shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under POSCO Act, Barrackpore. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and the petitioner shall not leave the jurisdiction of 24 Parganas (North) without prior permission of the learned trial court.
Accordingly, CRM (M) 2226 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
