Petitioner complains that the private respondents are attempting to disposes him as also encroach upon his property and sell out the property which is belonging to him.
Learned Advocate for the State has submitted a report. Report reflects that number of criminal cases have been initiated in respect of the parties including proceeding under Section 107 of Cr.P.C.
Having considered the submission advanced by the petitioner, I am of the opinion that if the petitioner is in possession petitioner should not be dispossessed from his possession without due process of law. As the petitioner has also expressing his apprehension that he may be not only dispossessed but the private respondents are also encroaching his property by way of alienating the property, to that effect petitioner would approach the jurisdictional civil court for appropriate directions. In the meantime, police authorities would ensure that there should not be any breach of the peace or tranquility
and/or any untoward incident should also crop up because of the inimical relationship between the petitioner and the private respondents.
With the aforementioned observations, the instant writ petition being WPA 25495 of 2024 is hereby disposed of.
Report so submitted be kept with the record.
Copy of the report be handed over to the learned Advocate appearing for the petitioner.
Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
